Welcome to our website, www.thehirestandardco.com (the “Site”). This site is designed to connect applicants seeking employment with employers looking to hire personal or domestic staff.  The Hire Standard Co. is committed to providing an equal opportunity in all its operations and prohibits discrimination in employment, services, and activities based upon race, religion, colour, sex, gender, gender identity, sexual orientation, age, national origin, disability, veteran status, or any other protected class under applicable law. Please review these terms and conditions carefully.  IF YOU DO NOT AGREE TO THE TERMS, PLEASE DO NOT REGISTER FOR ANY THE HIRE STANDARD COMPANY, LLC SERVICES.

Agreement. This Terms of Use agreement (the "Agreement") governs your access to and use of the Site. This Agreement may be modified at any time by The Hire Standard Company LLC (“The Hire Standard Co.”) by posting the modified Agreement to the Site. Any such modifications shall be effective immediately upon posting unless some other effective date is expressly stated. You can view the most recent version of this Agreement at any time at www.thehirestandardco.com. Your use of this Site shall constitute and be deemed your unconditional acceptance of this Agreement.

  1. Privacy. Your use of the Site is also governed by our Privacy Policy, which is hereby incorporated into this Agreement. Please review our Privacy Policy at www.thehirestandardco.com/privacypolicy. The Hire Standard Co. reserves the right, and you authorize us, to use and assign all information provided by or collected from you in any manner consistent with our Privacy Policy.

  2. Site Content. The Site is provided on an “as is” basis and may use internet services that are not under our direct control. While we strive to provide accurate descriptions of our products and services, we do not warrant that the descriptions, pricing, or other content on the Site are accurate, complete, or current. We reserve the right to correct errors and to cancel any orders that were placed using incorrect descriptions or pricing. We do not warrant that the Site or its features will be accessible at all times or that it will function in an error-free manner. We reserve the right to cease operating the Site or any of its features at any time.

  3. Intellectual Property. All content on this Site including without limitation graphics, logos, trademarks, images, and software is, and shall continue to be, the property of The Hire Standard Co. or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site.

  4. Site Use. The Hire Standard Co. grants you a limited, revocable, nonexclusive license to use this Site solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You agree not to copy content from the Site, reverse engineer or hack into the Site, or use materials, products or services in violation of any law. Your use of this Site is at the discretion of The Hire Standard Co. who may terminate your access and use at any time.

  5. Account Security. Each user is responsible for any misuse of their account, even if the inappropriate activity was actually committed by someone other than the account holder (e.g., family member or friend). Users must take all reasonable steps to protect their accounts from unauthorized access, including ensuring the security of their passwords at all times and not sharing them with others.

  6. Prohibitions on Use. Users are prohibited from using the Website or the Service:

  1. In any manner that violates any federal, state, international, or local law or regulation;

  2. In a manner that materially interferes with our activities or overall business or harms any of our customers, employees, affiliates, agents, officers, or directors;

  3. To threaten, bypass, or destroy any security mechanism used with or incorporated in the Website or the Service;

  4. To disparage, denigrate, insult, or otherwise make pejorative statements about the Company and/or any of its affiliates, directors, officers, employees, partners, brand, products, or service;

  5. To transmit any content or information that is offensive, lewd, pornographic, defamatory, libelous, harassing, tortious, abusive, illegal, prejudice, discriminatory, or otherwise inappropriate or objectionable;

  6. To transmit any marketing, advertising or promotional materials, including without limitation any “spam,” "junk mail," or other deceptive or unsolicited bulk or commercial email;

  7. To harm, or attempt to harm, minors in any way;

  8. To modify, sub-license, adapt, translate, reverse engineer, sell, disassemble, or decompile any portion of the Service and/or the Website’s functionality;

  9. To impersonate the Company (including any Company officer or employee), any user of our Website and/or Service, or any other person or entity;

  10. To transmit any content, data, or material that infringes the intellectual property rights or other protective rights of any third parties;

  11. To use the Service and/or the Website in connection with unsolicited, unwanted, or harassing communications, including without limitation, SMS messages, phone calls, voice mail, chat, video, or email;

  12. To transmit any content, data, or material that contains viruses, spyware, spiders, robots, worms, Trojan horses, logic bombs, or any other type of malicious or deleterious programs;

  13. To use the Website or the Service to collect information about other users, including phone numbers or email addresses, without any such individual’s prior explicit consent or otherwise under false pretenses of any kind;

  14. In any manner that violates any other applicable policy maintained by the Company, including without limitation the Company’s Privacy Policy, Terms of Use, and Copyright Policy;

  15. To use the Service or Website to record or monitor a phone call or other communication without first obtaining express consent from the participants per applicable law (such as California’s Invasion of Privacy Act);

  16. In any manner that can reasonably be considered contrary to the Company’s goodwill, public image, and overall reputation;

  17. To express or imply that any user’s statements, activities, or causes are endorsed by the Company;

  18. To collect, or attempt to collect, personal information about users or other third parties without their prior knowledge and affirmative consent;

  19. To divulge any of the Company’s (or any affiliate’s) proprietary information;

  20. In any manner that promotes any illegal activity (such as driving under the influence, illegal drug use, violence, child abuse, or underage drinking);

  21. To knowingly receive, use, re-use, upload or download any material which contains:

  • material that may reasonably be considered obscene, defamatory, offensive, abusive, hateful, inflammatory, harassing, violent, or otherwise objectionable;

  • Promotes pornographic or other sexually explicit material, discrimination, or violence, based on race, religion, nationality, sex, gender, disability, age, or sexual orientation;

  • Is likely to deceive any person acting reasonably under the circumstances;

  • Impersonates any person; or

  • Involves commercial activities or sales.

  1. Reporting Violators.  Any user who believes that a violation of this Agreement or any other Company policy has taken place should report the alleged violation to the Company promptly. Such reports should include:

    1. Name of alleged violator(s);

    2. Date and time (including time zone) of the alleged violation(s);

    3. The IP address(es) used to commit the alleged violation(s);

    4. Description of alleged violation(s);

    5. Evidence of the alleged violation(s) (including screenshots and videos); and

    6. The reporter’s involvement, if any, in the violation (and how the violation was discovered).

  1. Monitoring and Enforcement. The Company reserves the right to regularly monitor third-party use of the Website and the Service to confirm compliance with this Agreement and any other applicable Company policy. We may delete any material we deem illegal, inappropriate, or violative of any Company or third-party policy, and take whatever action we deem necessary to address any behavior including disclosing the user’s personal information to a third party claiming a rights violation, taking legal action, or suspending or terminating the user’s access to the Service and the Website.

  2. Confidentiality. It is agreed that all personal information given to www.thehirestandardco.com or Website Owner, will be kept confidential by The Hire Standard Co. and Website Owner, with the following exceptions: (1) basic biographical information (i.e., age, sex, race) will be posted with your user ID for others to view; (2) you actively choose to post your personal information for others to see; (3) you send a message to another client, which will disclose your e-mail address to that client or (4) you have harassed another person via any service provided by www.thehirestandardco.com, in which case the confidentiality clause contained in this Agreement is rendered null and void.

  3. Links to Other Sites. The Site may provide links to other websites. This Site’s Terms of Use or Privacy Policy may not apply to those other websites, which may have their own terms and policies. You should review the terms of use and privacy policies of any other websites that you visit. 

  4. Compliance with Laws. You must abide by all Federal, State and local laws. If you are outside the United States you must comply with all local laws with respect to your online conduct, as well as the export of data to the United States or to your country or residence.

  5. Indemnification. You agree to indemnify, defend and hold The Hire Standard Co. and our partners, employees, and affiliates, harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.

  6. No Guarantee of Placement. The Hire Standard Co. does not guarantee placement of any applicant with any employer through the use of this Site. All employment decisions are at the sole discretion of the employers using the Site.

  7. THE INFORMATION ON THIS SITE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. THE HIRE STANDARD CO. DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL BE TO DISCONTINUE USING THE SITE.

  8. UNDER NO CIRCUMSTANCES WILL THE HIRE STANDARD CO. BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR SITE USE, OR THE CONTENT,OR ANY RELATIONSHIP, INTERACTIONS, OR DISPUTES BETWEEN THE EMPLOYER AND ANY WORKER PLACED BY THE STAFFING AGENCY, INCLUDING BUT NOT LIMITED TO CLAIMS RELATED TO EMPLOYMENT TERMS, PERFORMANCE, COMPENSATION, DISCIPLINE, OR TERMINATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE CLIENT ACKNOWLEDGES THAT THE STAFFING AGENCY IS NOT THE EMPLOYER OF ANY WORKER PLACED WITH THE CLIENT AND ASSUMES FULL RESPONSIBILITY FOR COMPLIANCE WITH ALL EMPLOYMENT-RELATED OBLIGATIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.

  9. Copyrights and Copyright Agent. If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to our Copyright Agent at info@thehirestandardco.com subject line: COPYRIGHT CLAIM:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

  2. A description of the copyrighted work that you claim has been infringed;

  3. A description of where the material that you claim is infringing is located on the Site;

  4. Your address, telephone number, and e-mail address;

  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

  1. Applicable Law. You agree that the laws of the State of Texas without regard to conflicts of laws provisions will govern this Agreement and any dispute that may arise between you and The Hire Standard Co. or its affiliates. Venue shall be the state and federal courts located in Texas.

  2. Severability. If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

  3. Relationship of the Parties. Each party is, and shall remain, an independent contractor and nothing contained in this Agreement shall be construed to make either party a partner, joint venturer, employee or agent of the other party, and neither party shall hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party.

  4. Waiver. The failure of Website or Website Owner to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.  Any waiver of this Agreement by Website or Website Owner must be in writing and signed by an authorized representative of the Website Owner.

  5. Equal Opportunity and Non-Discrimination Clause.
